These Terms of Use (“Terms”) govern your access to and use of the website located at www.petesfishandchips.com (the “Site”), operated by Pete’s Fish & Chips, Inc. (“Pete’s,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, please do not use the Site.

1. Use of the Site

The Site is provided primarily for general informational purposes, including information about our restaurants, menus, history, and locations, and to allow you to contact us. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for your personal, non-commercial purposes.

2. Intellectual Property

The Site and its content, including text, photographs, graphics, logos, designs, the Pete’s Fish & Chips name and marks, and the selection and arrangement of such content, are owned by or licensed to Pete’s and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, publish, display, create derivative works from, or otherwise use Site content without our prior written permission.

You may view and print pages from the Site solely for your personal, non-commercial use.

3. Contact Form and User Submissions

The Site may include a contact form through which you can provide information such as your name, email address, and a message. You may also have the option to sign up to receive news and updates from us. Any information or content you submit through the Site is referred to as a “Submission.” By making a Submission, you represent that the information you provide is accurate, that you have the right to provide it, and that your Submission does not violate applicable law or the rights of any third party.

You are responsible for your Submissions. You may not submit content that is unlawful, threatening, harassing, defamatory, obscene, infringing, fraudulent, or otherwise inappropriate. You should not submit sensitive personal information, such as financial account information, government identification numbers, or health information, through the Site.

We are not obligated to review, use, or respond to any Submission and may decline to act on or remove a Submission at our discretion.

By making a Submission, you grant us a non-exclusive, royalty-free right to use, store, reproduce, and otherwise process the Submission as reasonably necessary to respond to you, operate and administer the Site, and conduct related business activities. If you affirmatively opt in to receive news or updates, we may also use the contact information you provide for that purpose. We make reasonable efforts to keep information on the Site accurate and current. However, menus, food items, prices, hours of operation, locations, promotions, and other information may change without notice or contain errors or omissions. Our restaurants currently operate on a cash-only basis.

Information displayed on the Site should be confirmed with the applicable restaurant location when appropriate. The Site and its content are provided for informational purposes only. We do not guarantee that the Site or any particular content will always be available, complete, accurate, or error-free.

5. Third-Party Websites and Social Media

The Site may contain links to third-party websites, social-media platforms, or other online services that we do not own or control. These links are provided for convenience only. We are not responsible for the availability, content, products, services, security, privacy practices, or other practices of third-party websites or services.

Your use of third-party websites and services is subject to the terms and policies of those third parties.

6. Prohibited Conduct

You agree not to:

  • use the Site in violation of any applicable law or regulation;

  • infringe or violate the rights of Pete’s or any third party;

  • interfere with, disrupt, damage, or compromise the operation or security of the Site;

  • attempt to gain unauthorized access to the Site, accounts, servers, networks, or systems connected to the Site;

  • introduce viruses, malware, malicious code, or other harmful technologies;

  • submit false, fraudulent, or misleading information;

  • impersonate another person or misrepresent your affiliation with any person or entity; or

  • use bots, scrapers, crawlers, or other automated means to access, collect information from, or interact with the Site except as expressly authorized by us or permitted by applicable law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT AND INFORMATION AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, SECURE, AVAILABLE, OR FREE FROM ERRORS OR HARMFUL COMPONENTS.

Some jurisdictions may not permit the exclusion of certain warranties, so portions of this Section may not apply to you.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PETE’S FISH & CHIPS, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, OR DATA, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

The limitations in this Section apply regardless of the form or theory of liability and even if we have been advised of the possibility of such damages. Some jurisdictions may not permit certain limitations of liability, so portions of this Section may not apply to you.

9. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Pete’s Fish & Chips, Inc. and its officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and reasonable costs and expenses, including attorneys’ fees, arising out of or relating to your misuse of the Site, your Submissions, or your violation of these Terms or applicable law.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to principles of conflicts of law. To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to the Site or these Terms must be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction and venue of those courts.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of these Terms. Any updated Terms will become effective when posted on the Site unless otherwise stated. Your continued use of the Site after updated Terms become effective constitutes your acceptance of those Terms.

12. Severability and Entire Agreement

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pete’s regarding your use of the Site.
